Legal innovation brings vitality

Hong Kong-related legal cases and mediation disputes received by the Qianhai Cooperation Zone People’s Court as of the first half of 2021 have outnumbered most of mainland courts, according to official data. This reveals the vitality of Shenzhen-Hong Kong cooperation in Qianhai, as over 10,000 Hong Kong-funded enterprises conduct business either in the area or elsewhere in the city.

In an interview with Shenzhen Daily, Lin Yan, an intellectual property (IP) judge with the court, said her schedule was fully packed with court hearings. “My busy work schedule actually reflects Qianhai’s vigorous economy as the number of companies increases and the country has rolled out stricter IPR protection rules,” said Lin.

The Qianhai court was the only court in the city designated to deal with Hong Kong, Macao, Taiwan and foreign-related civil and commercial cases. By the end of June, it had accepted 8,392 Hong Kong-related cases, with 566 heard by Hong Kong assessors.

“Qianhai court appointed Hong Kong assessors and mediators to participate in handling of cases. It also allows Hong Kong, Macao, Taiwan and foreign parties to ascertain their local laws and apply for enforcement,” said Song Liang, head of the department of the rule of law of Qianhai Authority. “This is just one example of Qianhai’s legal innovation.”

“In recent years, innovative legal institutions such as Shenzhen Court of International Arbitration and the First Circuit Court of the Supreme People’s Court have settled in Qianhai, providing final rulings.

“Qianhai also encourages the setting up of a mediation alliance that consists of 15 Hong Kong mediation institutions to provide training and issue certificates for trainees,” Song said.
