Qianhai court initiates new dispute governance model

The Shenzhen Qianhai Cooperation Zone People’s Court on Aug. 5 announced it will join hands with six professional institutions to establish six sub-centers of its diversified dispute resolution center to govern disputes with a new model.

The six sub-centers include the diversified dispute resolution sub-centers for cases involving matters of international trade, the Guangdong-Hong Kong-Macao Greater Bay Area (GBA), international investment, small and micro-sized private enterprises, emerging finance, and the free trade area.

The court will construct the sub-centers in conjunction with the Mediation Center of China Council for the Promotion of International Trade Shenzhen Branch, the Benchmark Chambers International and Benchmark International Mediation Center, the Shenzhen Qianhai International Commercial Mediation Center, the Shenzhen Promotion Union of Small Enterprises, the Shenzhen Factors Association, and the Qianhai Notary Office, respectively.

The Qianhai court will assign judges to the six sub-centers to provide judicial guidance, and the mediation cases of the court will be distributed to different sub-centers for mediation. In addition, 164 specially invited mediators of the court will be allocated to the six sub-centers according to their personal wishes. The move is expected to realize the classified management of the mediators and promote the professionalization of the court’s mediator system.

The six sub-centers will play a number of functions such as professional training, special research and legal consultation through joint Party building. The court’s effort is conducive to fully mobilizing Qianhai’s original cross-border dispute resolution resources, optimizing and integrating dispute resolution resources of Guangdong, Hong Kong and Macao, improving the modernization level of social governance, and creating a new model of dispute source governance with distinctive Qianhai characteristics.

The court will also take advantage of the sub-centers’ accumulated foundation in cross-border mediation to absorb the experience of dispute resolution in the GBA, promote the convergence of international commercial mediation rules within and outside its jurisdiction, and build a platform for the convergence of mediation rules and mechanisms in the GBA.
