International arbitration service available at the Qianhai-based Shenzhen Court of International Arbitration (SCIA) has been part of the efforts by the free trade area authority to create a fair, transparent and rule-of-law business environment.

Following years of efforts, the SCIA has set up an international governance structure with the international council at its center. Under the governance structure, the decision-making power, the supervisory power and the enforcement power are checked and balanced.

The SCIA has also addressed the concerns of its domestic and overseas litigants on its credibility and independence by making the arbitration institution and the arbitration tribunal operation independently.

The first arbitration institution in China to hire foreign arbitrators, SCIA currently has 385 foreign arbitrators from 77 countries and regions, accounting for 41 percent of its total.

SCIA has also created a mechanism that integrates arbitration, mediation, negotiation and expert review to resolve disputes.

Since 1997, all of SCIA’s arbitral decisions have been executed by Hong Kong arbitration institutions. Official statistics showed that in 2014, 38.5 percent of the arbitral decisions executed in Hong Kong were made by SCIA, higher than any arbitration institution in China.

SCIA has partnered with multiple international arbitration organizations, such as the United Nations Commission on International Trade Law (UNCITRAL), the ICC International Court of Arbitration, the Judicial Arbitration and Mediation Services Inc. (JAMS), and the Singapore International Mediation Centre (SIMC), for better services in international arbitration.

The “selective repeated arbitration mechanism” initiated by SCIA was nominated for the 2019 Global Arbitration Innovation Award of Global Arbitration Review (GAR).
